This Legal Notice (hereinafter, “the Legal Notice”) governs access to and use of the website accessible through the domain name www.cyberclick.es/ and its subdomains (hereinafter, “the Website”). The simple access to the Website confers the status of user of the same (hereinafter, “the User”). If the User does not agree with this Legal Notice, he/she must immediately leave the Website without using it.

The simple access to the Website is free of charge except for the cost of connection through the telecommunications network supplied by the access provider contracted by the User.

The User undertakes to use the Website and all its content and services in accordance with the law, morality, public order and this Legal Notice. Likewise, the User undertakes to make appropriate use of the services and/or contents of the Website and not to use them for illicit or criminal activities that infringe the rights of third parties or that violate any applicable legal regulation.

  5. Not to transmit unsolicited or unauthorized advertising, promotional material, "junk mail", "chain letters", "pyramid schemes", or any other form of solicitation, except in those areas (such as commercial spaces) which are exclusively designed for this purpose.
  6. Not to introduce or disseminate any false, ambiguous or inaccurate information and content in such a way as to mislead the recipients of the information.
  7. Not to impersonate other Users by using their registration codes to access the different services and/or contents of the Website that require it.
  8. Not to disseminate, transmit or make available to third parties any type of information, element or content that violates the intellectual and industrial property rights, patents, trademarks or copyrights of the owners of the Website or third parties.

The User undertakes to hold CYBERCLICK completely harmless against any possible claim, fine, penalty or sanction that CYBERCLICK may be obliged to bear as a consequence of the breach by the User of any of the rules of use indicated above. In any case CYBERCLICK also reserves the right to request the corresponding compensation for damages.

 

4. Content and services linked through the Website

The Website may contain technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter "Linked Sites"). In these cases, UN CYBERCLICK will only be responsible for the contents and services supplied on the Linked Sites to the extent that it has effective knowledge of their unlawfulness and has not deactivated the link to them with due diligence. In the event that the User considers that there is a Linked Site with illicit or inappropriate content, he/she can inform CYBERCLICK.

 

Under no circumstances should the existence of Linked Sites presuppose the formalization of agreements between CYBERCLICK and those responsible for or owners of the same, nor the recommendation or promotion of the Linked Sites and/or their contents by CYBERCLICK. Unless expressly indicated to the contrary on the Website, CYBERCLICK has no knowledge of the contents and services of the Linked Sites and, therefore, accepts no responsibility for any damages that these may cause to the User or any third party.

 

5. Intellectual and industrial property

All the contents of the Website, which are understood to include, but not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes, are the intellectual property of CYBERCLICK or third party licensors, and none of the exploitation rights recognized by the current legislation on intellectual property on them can be understood to be transferred to the User.

 

The trademarks, trade names and other distinctive signs published on the Website are owned by CYBERCLICK or third party transferors and/or licensors, without any right over them being transferred to the User.

7. Nullity and ineffectiveness of the clauses

If any clause included in this Legal Notice is declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect such provision or the part of it that is null or ineffective, subsisting this Legal Notice in everything else and considering such provision totally or partially not included.

 

8. Applicable law and competent jurisdiction

This Legal Notice shall be governed by and construed in accordance with Spanish law.
